Pennsylvania's Right to Know Law and How to Limit Public Exposure to Your Company's Private Records— given how much information companies must turn over to the government, companies must understand their increased risk to these documents suddenly becoming open to public access and scrutiny under Pennsylvania's Right to Know Law.


Due to recent Commonwealth Court rulings, many records that companies (referred to as the third party) consider "private" are now available for public access— and companies are unaware they face this risk. Examples of potentially sensitive records include donor and customer lists, payroll records, even email communications.


To help companies understand Pennsylvania's Right to Know Law (RTKL) as it pertains to public records, with special emphasis on how companies' private records can suddenly become public, and the steps you can take to limit public exposure to your company's private records, top litigation attorneys Mark Seiberling and Joshua Voss will explain:

  • The basics of Pennsylvania'’s RTKL including purpose, function, the definition of what is considered a public record; how people gain access to public records; what records are exempt from becoming a public record; and response deadlines that agencies must follow when they receive a request for a record
  • How the RTKL implicates companies' (third parties) records including what is considered the government agency possession, what is the third party's or contractor's
  • The RTKL procedure—including what to do should your company receive a notice from a government agency about a records request, legal rights and the appeals process
  • Areas of concern for businesses including what to do if the information requested is trademarked or proprietary information; who really is the possessor of the information as defined by recent court rulings; and how the RTKL is used as a discovery tool
  • Tips and best practices for businesses to protect themselves.
