HARRISBURG - Pennsylvania Chamber of Business and Industry President and CEO Gene Barr issued the following statement today regarding the PA Chamber’s participation in the case of Dolores Frederick, et al. v. Allegheny Township ZHB v. CNX Gas Company, LLC. Arguments are being heard today before an en banc panel of Commonwealth Court in Pittsburgh in a case regarding, in part, how the state’s Environmental Rights Amendment influences local zoning decisions.
“The PA Chamber is pleased that the Commonwealth Court has agreed to allow us to submit a brief in this case and present arguments. Our position in the matter at hand is that a zoning ordinance does not and cannot deprive a private citizen of any of their rights. We disagree with the arguments raised by some that would use the Environmental Rights Amendment as the basis to limit the lawful exercise of private property rights. We stand ready and willing to have our voice heard in the courts to protect the rights of property owners.”
