The Equal Employment Opportunity Commission (EEOC) recently released guidance on this important and emerging topic. This program will discuss the technical guidance, including how existing ADA requirements may apply to the use of AI in employment-related decision making, and will offer promising practices for employers to help with ADA compliance when using AI decision making tools. In addition, this program will survey existing legislation in this area, legislation which may soon make its way to Pennsylvania employers. Option #2:Money Talks: Pay EquityPresenter: Christopher Durham, Duane Morris, LLPLocation: Nigerian Room Description: As companies continue to increase their commitment to workplace diversity, equity and inclusion, pay equity issues have steadily moved to the forefront in the minds of not only the business community, but also legislators and enforcement agencies at the state and federal level. Numerous state and local jurisdictions have passed enhanced laws relating to workplace pay equity, including pay range disclosure requirements and salary history bans. Multiple states also require, or are poised to require, reporting of employee pay data, and the EEOC is likely to reinstitute a similar pay data reporting requirement at the federal level. On the regulatory front, pay equity continues to be a focus of enforcement agencies. This breakout session will provide an overview of the legal and regulatory landscape relating to workplace pay equity, and provide recommendations and strategies for businesses to maximize compliance and minimize legal and business risk in this area.
